10. Hyperlinks
10.1. DOGAMÍ company reserves the right to set up hyperlinks on its Website and the Apps, giving access to third parties web pages other than those on its Website, over which DOGAMÍ has no control.
10.2. The DOGAMÍ company declines all responsibility for the conditions of access to these web pages, their operation, their use of Users' personal data and the content of the information provided on these web pages when the hyperlinks are activated.
10.3. Any User who has a personal website and wishes to place, for personal purposes, on his website a simple link leading directly to the home page of the DOGAMÍ Website and Apps must obtain the express authorisation of the DOGAMÍ company to establish this link.
10.4. Under no circumstances may this authorisation be qualified as an implicit affiliation agreement.
10.5. In any case, the hypertext links referring to the Website and the Apps without the authorisation of the DOGAMÍ company must be withdrawn at the first request of the DOGAMÍ company.
11. Security
11.1. DOGAMÍ does its best, in accordance with the rules of the art, to secure the Website and the Apps about the risk incurred and the nature of the data processed. However, the DOGAMÍ company can only be held responsible in the event of a proven fault attributable to the latter. It cannot guarantee absolute security.
11.2. It is forbidden for the User to access or to remain, fraudulently, in all or part of the Website and the Apps. He/she is prohibited from using any access method other than the interface made available by the DOGAMÍ company. In the event of the discovery of such a method or if the User inadvertently enters a reserved space without the right, he/she undertakes to inform the DOGAMÍ company of this without delay by e-mail to the address hello@dogami.io so that it can take the necessary measures.
11.3. It is forbidden for the User to delete or modify data contained on the Website and the Apps which has not been published by himself or to fraudulently introduce a date or event to alter the functioning of the Website and the Apps. In particular, he/she shall ensure that he/she does not introduce viruses, malicious code or any other technology harmful to the Website and the Apps.
11.4. Any access to a prohibited area will be considered as unauthorised access to a data processing system within the meaning of Article 143 bis of the Swiss Criminal Code.
11.5. The User undertakes to treat all data that he/she becomes aware of during such access to an unauthorised area as confidential data and therefore undertakes not to disclose them.
11.6. The User agrees not to carry out any operation aimed at saturating a page, bouncing functions or any process that would hinder or distort the functioning of the Website and the Apps.
11.7. The User undertakes not to use any devices or software of any kind that would have the effect of disrupting the proper functioning of the Website and the Apps.
11.8. The User undertakes not to take any action that would impose a disproportionate burden on the Website and the Apps's infrastructure.
11.9. The User accepts the characteristics and limits of the Internet. He/she is aware that the data circulating on the Internet is not necessarily protected, particularly against possible misappropriation.
11.10. The User shall take the appropriate measures to ensure the security of his/her own data and/or software from contamination by any viruses on the Internet.
12. Responsibility of the DOGAMÍ Company
12.1. DOGAMÍ cannot be held responsible for:
12.1.1. the quality of the Website and the Apps, the services being offered "as is" and "as available";
12.1.2. the disruption of the use of the services;
12.1.3. the impossibility of using the services;
12.1.4. breaches of computer security, which may cause damage to Users' computer equipment and data;
12.1.5. the collectables or cryptocurrencies losses of Users.
12.2. The User is aware that under no circumstances does DOGAMI undertake to keep or store any kind of digital assets (including, of course, Collectibles and DOGAs) for or on behalf of Users. Any transfer of ownership that might occur in any unique digital asset occurs on the decentralized ledger within the blockchain network, which DOGAMI does not control.
12.3. In the specific case where the User collects a reward within the Marketplace (in DOGA) and decides not to redeem it, the User will not be the actual owner of the unredeemed DOGAs but will merely have a right to redeem such DOGAs from DOGAMI, which will remain the actual owner of the digital assets until the reward is redeemed.
